How to get a proper Affidavit in Sri Lanka?

What is an Affidavit?

An affidavit is a written statement by a person under an oath or affirmation.

An affidavit is administered, signed, and sealed by a registered lawyer, the high court, and the ministry.

An affidavit includes a related person's personal details, family details, document details, and a comparison of each document detail. 

An affidavit includes an oath or affirmative statement to each document's comparison is true and it states about the same person even if there are some differences.

An affidavit includes several signs and seals at the bottom of the statement.

1. Related person's signature.

2. The lawyer's name, signature, and seal.

3. The ministry's signature, and seal.

The lawyer, 

1. Should be registered in the high court.

2. Should have a valid seal.

3. Should able to issue high court receipts.

The lawyer should meet all the requirements above to certify a valid affidavit

What is the routine of collecting a proper affidavit in Sri Lanka?

First, you have to visit a sworn translator who prepares affidavits related to the situation.

Because in Sri Lanka, most documents are written in the Sinhala language. therefore you need a sworn translator to translate all your documents to English and prepare the affidavit.

What documents you have to submit to the sworn translator?

The sworn translator will make a list of documents needed to be related to your situation. Such as,

1. Applicant's identification documents: NIC, Passport, Birth certificate.

2. Applicant's residential documents: Grama Sevaka Certificate.

3. Police report from Sri Lanka police and if you visited in a foreign country, you have to submit police reports related to that period too.

4. Applicant's parents' identification documents.

5. Applicant's spouse's identification documents even if married or separated or divorced or widowed.

6. Applicant's childs' identification documents.

7. Applicant's marriage certificate even if married several times you have to submit each certificate.

8. Applicant's siblings' identification documents.

9. Death certificates if the applicant's family member has died.

10. If the applicant's family member is working in a foreign country: his/her identification documents, work permit documents, visa. 

The sworn translator will translate all the documents and prepare an affidavit for you.

After prepared the affidavit you have to take all your translated documents and the prepared affidavit to the lawyer.

The applicant needs to sign the affidavit in front of the lawyer.

The lawyer will check all your original documents, translated documents, and the affidavit. After that, the lawyer will certify the affidavit by signing and seal. The lawyer will take a small payment from the applicant and issue a receipt.

At last, you have to take all your original documents, translated documents, and the affidavit signed and sealed by the lawyer to the Foreign Ministry. In there the authorized officer will do the final checking, certifying, and seal the affidavit.

Now you have a proper affidavit. Usually, an affidavit is valid for up to six months but depends on the current situation.
